Terms of Service

These Terms of Service (“Terms,” “Agreement”) constitute a legally binding contract between you (“User,” “you,” “your”) and AlethicOS (“Company,” “we,” “us,” “our”), governing your access to and use of the AlethicOS platform, including all related websites, applications, features, content, and services (collectively, the “Service”).

PLEASE READ THESE TERMS CAREFULLY. By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

1. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age or the age of majority in your jurisdiction;
• You have the legal capacity to enter into a binding contract;
• You are not prohibited from using the Service under any applicable law;
• All registration information you submit is truthful, accurate, current, and complete;
• You will maintain the accuracy of such information throughout your use of the Service.

We reserve the right to refuse access, terminate accounts, or remove content at our sole discretion, without notice or liability, for any reason, including violation of these Terms.

2. Description of Service

AlethicOS is a cognitive organization platform that provides AI-assisted tools for personal decision-making, reflection, and mental clarity. The Service includes, but is not limited to:

• Guided reflection sessions using AI-powered Socratic questioning;
• Mental mapping and decision visualization tools;
• Focus and ambient soundscape features;
• Cognitive analytics and burnout prediction;
• Decision history tracking and export functionality.

3. Critical Disclaimers — AI and Health

You expressly acknowledge and agree that:

• The Service does not provide medical, psychological, psychiatric, legal, financial, or professional advice of any kind;
• AI-generated responses are not reviewed, verified, or endorsed by licensed professionals;
• The Company does not guarantee the accuracy, completeness, reliability, suitability, or safety of any AI-generated content;
• You are solely responsible for all decisions you make based on information obtained through the Service;
• The “burnout prediction” and “cognitive profile” features are informational tools only and are not clinical diagnostic instruments;
• Any cognitive bias detection is algorithmic in nature and may not accurately reflect your actual cognitive processes;
• You will not use the Service as a replacement for professional care or to delay seeking professional help.

4. Account Registration and Security

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information;
• Maintain and promptly update your information;
• Maintain the security and confidentiality of your login credentials;
• Notify us immediately of any unauthorized access or breach of your account;
• Accept full responsibility for all activity under your account.

You may not share, transfer, or sell your account to any other person. We are not liable for any loss or damage arising from your failure to safeguard your account credentials. One person may only maintain one account.

5. Subscription, Billing, and Payments

5.1 Free Trial

New users may be offered a free trial period of seven (7) days. During the trial, you will have access to limited features of the Service. At the end of the trial period, your access to premium features will be restricted unless you subscribe to a paid plan. We reserve the right to modify, limit, or discontinue the free trial at any time without notice.

5.2 Paid Subscriptions

Paid plans are billed in advance on a recurring basis (monthly, annually, or as otherwise offered) at the price displayed at the time of purchase. All prices are in US Dollars unless otherwise stated. We reserve the right to change subscription prices with at least 30 days' prior notice. Price changes will take effect at the beginning of your next billing cycle.

5.3 Payment Processing

Payments are processed through Stripe, Inc. (“Payment Processor”). By providing payment information, you authorize the Payment Processor to charge your payment method. We do not store your full credit card details on our servers. You agree to Stripe's terms of service.

5.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period. No partial refunds will be issued for unused portions of a billing period unless required by applicable law.

5.5 Refund Policy

Refund requests may be submitted within fourteen (14) days of the initial purchase or renewal. Refunds are provided at our sole discretion. For users in the European Union, you have a statutory right of withdrawal within 14 days of purchase, subject to exceptions where the digital service has been fully performed with your prior express consent. 6. Acceptable Use Policy

You agree NOT to:

• Use the Service for any unlawful, harmful, or fraudulent purpose;
• Attempt to access, tamper with, or use non-public areas of the Service, our systems, or third-party systems;
• Attempt to probe, scan, or test the vulnerability of the Service or circumvent any security measures;
• Interfere with or disrupt the access of any user, host, or network;
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service;
• Scrape, data-mine, or use automated means (bots, crawlers, spiders) to access the Service;
• Introduce malware, viruses, or any other harmful code;
• Access another user's account or personal data without authorization;
• Use the Service to generate content that is illegal, abusive, harassing, defamatory, or that infringes on any third party's rights;
• Attempt to manipulate, exploit, or abuse the AI systems, including prompt injection attacks;
• Resell, redistribute, sublicense, or commercially exploit any part of the Service without our prior written consent;
• Use the Service to compete with or create a substantially similar product or service.

Violation of this policy may result in immediate termination of your account, without refund, and may be reported to law enforcement authorities.

7. Intellectual Property Rights

7.1 Our Property

The Service, including all content, features, functionality, software, code, design elements, trademarks, trade names, logos, graphics, and documentation (collectively, “Company IP”), is owned by or licensed to AlethicOS and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Company IP, except for the limited right to use the Service as expressly permitted herein.

7.2 Your Content

You retain ownership of the content you create through the Service, including your decision entries, reflection text, and personal data (“User Content”). By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to process, store, display (to you), and transmit your User Content solely for the purpose of providing, maintaining, and improving the Service. This license terminates when you delete your content or your account, subject to reasonable backup and archival periods.

7.3 Feedback

If you provide feedback, suggestions, or ideas regarding the Service (“Feedback”), you grant us an irrevocable, perpetual, worldwide, royalty-free license to use, modify, and incorporate such Feedback without any obligation or compensation to you.

8. Third-Party Services and APIs

The Service integrates with and relies on third-party services, including but not limited to:

• OpenAI — for AI-powered conversation processing;
• Supabase — for authentication and data storage;
• Stripe — for payment processing;
• Resend — for transactional email delivery.

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices, availability, or reliability of third-party services. Outages, changes, or discontinuation of third-party services may affect the availability or functionality of the Service, and we shall not be liable for such disruptions.

You agree to defend, indemnify, and hold harmless AlethicOS, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, expenses, and fees (including reasonable attorneys' fees) arising from or relating to: (a) your use of and access to the Service; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; (d) any claim that your User Content caused damage to a third party; or (e) any decisions you make based on content obtained through the Service. This indemnification obligation shall survive the termination of these Terms and your use of the Service.

12. Termination

12.1 By You

You may terminate your account at any time by deleting your account through the Settings page or by contacting us at hello@alethicos.com. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

12.2 By Us

We may suspend or terminate your access to the Service, without prior notice or liability, for any reason, including (but not limited to): breach of these Terms, fraudulent activity, requests by law enforcement, discontinuation of the Service, or extended periods of inactivity. Upon termination, your right to use the Service ceases immediately.

12.3 Survival

The following provisions shall survive termination: Sections 3 (Disclaimers), 7 (Intellectual Property), 9 (Disclaimer of Warranties), 10 (Limitation of Liability), 11 (Indemnification), 13 (Governing Law), 14 (Dispute Resolution), and any other provisions that by their nature should survive termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions, unless otherwise required by mandatory local consumer protection laws in your jurisdiction. If you are a consumer in the European Economic Area (EEA), you will benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating any formal dispute proceedings, you agree to first contact us at hello@alethicos.com and attempt to resolve the dispute informally for at least thirty (30) days. Most disputes can be resolved through good-faith communication.

14.2 Jurisdiction

If an informal resolution is not reached, any disputes shall be submitted to the exclusive jurisdiction of the courts of Bursa, Republic of Turkey, unless mandatory local consumer protection laws require otherwise. If you are a consumer in the EU, you may also bring proceedings in the courts of your country of residence.

14.3 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this waiver is found unenforceable, the entirety of this dispute resolution provision shall be null and void.

15. Service Availability and Modifications

We do not guarantee that the Service will be available at all times. The Service may be subject to interruptions, including maintenance, updates, failures, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, without liability to you. We may also add, modify, or remove features, impose limits on certain features, or restrict access to parts of the Service.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the “Last Updated” date. For significant changes, we will also notify you via email (to the address associated with your account) at least thirty (30) days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

17. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, civil unrest, government actions, labor disputes, power failures, internet or telecommunications failures, cyberattacks, or disruptions to third-party services on which we rely.

18. Severability and Waiver

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect any other provisions, which shall remain in full force and effect. The remaining provisions shall be interpreted to achieve the original intent as closely as possible. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.

19. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or policies published by us on the Service, constitute the entire agreement between you and AlethicOS regarding the use of the Service. These Terms supersede and replace any prior agreements, communications, or understandings, whether written or oral, regarding the subject matter herein.

20. Assignment

You may not assign, delegate, or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may freely assign these Terms, including in connection with a merger, acquisition, corporate restructuring, or sale of all or substantially all of our assets. Subject to this section, these Terms shall bind and inure to the benefit of the parties, their successors, and permitted assigns.
